Brennan Jr: Scotus to Only Consider TROs When it Comes to Prediction Markets
Thursday September 3, 2026 (9:34 am EDT)
The Supreme Court has the opportunity to clear up a nationwide legal debate over whether sports prediction markets offer wagering or derivatives trading, with New Jersey regulators imploring justices to take up their spat with Kalshi.
Since the 3rd & 9th Circuit split only on whether to permit preliminary injunctions vs Kalshi, SCOTUS would only consider the question of the TROs. With no rulings on the merits regarding the law itself in either circuit, the wording of NJ’s cert petition seems premature https://t.co/UEAOfWmSCZ

Pete Hegseth Watch
Thursday September 3, 2026 (9:34 am EDT)
Prediction markets continue to give Secretary of Defense Pete Hegseth around a 30% chance of remaining in his job through December, though it is important to note that there is only an 8% chance of him exiting prior to October 1. Dan Driscoll said his last full day as U.S. Army secretary was Wednesday, but his social media post offered no explanation for why he is stepping down after 18 months as the service’s civilian leader. Driscoll is a friend of Vice President JD Vance and has good relationships with both Republicans and Democrats in Congress. But tensions with Hegseth have been widely reported, and some of Driscoll’s allies in the Army were ousted this year by President Donald Trump’s Pentagon chief. Driscoll spoke with Trump on the current state of the Army before he submitted his resignation this week, The Associated Press has reported.
