Motion to Dismiss in Kentucky Online Gambling Domain Seizure Case

The Internet Gaming and Media Association has released its Motion to Dismiss to the media on Friday responding to Kentucky's attempt at seizing various online gambling domain names.

Among the arguments being made by iMEGA.org, subject matter jurisdiction cannot be established because the subject domain names are not the property of the commonwealth of Kentucky.

Gov. Steve Beshear said his administration has asked a Franklin County Circuit Court judge to give the state control of 141 gambling Web site domain names. Beshear said he's looking to restrict Kentuckians' access to Web sites with names that include some of the most popular gambling sites for U.S. players: bodoglife.com, doylesroom.com and fulltiltpoker.com.

The commonwealth has already been successful at seizing some online gambling domain names, most notably www.goldencasino.com

A number of registrars are anticipated to attend this upcoming Tuesday's hearing in Frankfort, Kentucky.
