SEATTLE (Gambling911.com) - The prediction-market boom keeps running into the same wall: state judges who look at an “event contract” and see a bet.

King County Superior Court Judge John McHale is the latest. On Monday he granted Washington a preliminary injunction against Kalshi, finding the platform likely violated the state Gambling Act and Consumer Protection Act by running what amounts to an illegal gambling operation. McHale rejected Kalshi's core defense: that oversight by the U.S. Commodity Futures Trading Commission preempts state law. He asked both sides to return with terms by early August and plans to sign the order on the 5th.

Washington is not alone. The state joins Massachusetts, Michigan, Nevada and New York, each of which has won court orders reining in Kalshi's sports contracts. New York landed its ruling on July 8, when a federal judge refused to block enforcement of state gambling law.

But this is not a clean sweep. Kalshi has wins of its own. In April a divided Third Circuit panel held that the CFTC likely has exclusive jurisdiction over sports event contracts, siding with the platform against New Jersey. Tennessee courts handed Kalshi a restraining order and then an injunction of its own. With the circuits splitting, this fight looks Supreme-Court-bound, and the contracts aren't small change: sports events reportedly drive more than 85% of Kalshi's volume.

The industry is not neutral, either. The American Gaming Association argues prediction markets are simply rebranding sports wagering as “futures” to dodge state and tribal rules, and the consumer protections that come with a licensed book.

So where can you actually play?

Lost in all the docket-watching is the question most players are actually asking.

“The court fights get the headlines, but the average player just wants to know what's legal where they live, and that changes state by state,” says John Isaac, editor at online-gambling.com, which tracks the legal status of online gambling across US states.

That patchwork is the whole point. Regulated online casino play is live in only a short list of states; sports betting is legal in dozens more; and plenty of states still permit neither. The CFTC, meanwhile, is busy redrawing its own rulebook. A proposed federal rule would tighten which event contracts platforms can list at all.

For anyone 21 and up, the practical move hasn't changed: check your own state's rules before you deposit, stick to operators licensed by that state's regulator, and treat anything that promises to route around the law as the red flag it is.

Kalshi's lawyers will keep litigating jurisdiction. For everyone else, the map that matters is the one at the state line.
