Kentucky “New” Lawsuit for Recovering of Gambling Losses

The Interactive Media Entertainment & Gaming Association (iMega.org) appeared in a Frankfort, Kentucky court in a hearing on the Commonwealth's motion for leave to take discovery related to the identities of some 141 "unknown defendants" in a prolonged Internet gambling matter.  The Commonwealth has attempted to seize dozens of online gambling-related domain names.

The Commonwealth stated that it wishes to serve subpoenas to take the depositions of anyone it they believe has knowledge of owners behind various online gambling websites including Full Tilt Poker, which is the only company specifically named in the latest complaint. 

Counsel for the Interactive Gaming Counsel (IGC) claimed this is a violation of a stay issued by the Circuit Court.

The Commonwealth countered by suggesting the new suit is not affected by the stay, calling it an "independent action". 

The Court has yet to review the complaint and made no immediate ruling on the motion.  The IGC, however, has five days to object on behalf of its clients and an addition ten days should the IGC decide to file in writing.
