Court Upholds Nearly $60K Against Poker Player Dutch Boyd for Infringement

A panel of a federal appeals court has upheld a judgment of nearly $60,000 against poker player Dutch Boyd, whose real first name is Russell. 

The popular poker posting forum and publishing company TwoPlusTwo.com had brought the action claiming Boyd infringed on its trademark through the registration of “TwoPlusTwoPoker.com”.

The three-judge panel of the U.S. Ninth Circuit Court of Appeals on Friday found that Boyd had acted in “bad faith” by registering the domain name.   The “TwoPlusTwoPoker.com” domain name does not direct to any current website.

Two Plus Two Publishing LLC accused Boyd of cybersquatting and trying to divert online customers away from the Henderson company’s website, according to court documents.
Two Plus Two Publishing LLC has been rewarded $25,000 in statutory damages and $33,985 in attorney fees, saying the infringement by Boyd was “deliberate and willful.”
