
If you are looking to bet with TwinSpires from the state of Texas, whether it's the Kentucky Derby, Preakness or the Breeders Cup, you may have some difficulties.
TwinSpires announced last year (2025) they would begin once again taking bets from Texans after a 13 year absence. But the legal climate here is still up in the air, so to speak.

Why TwinSpires Won't Always Take Bets From Texas

The state made its opinion known back in 2011.
The Texas Racing Commission sent out letters that year to various horse betting sites licensed in the US, TwinSpires included, making it clear that they could lose their licenses. International sites for the most part remained undaunted, mainly since they do not physically accept bets inside the United States. They also do not blatantly advertise in the state. TwinSpires features prominently during the Kentucky Derby broadcasts.
“The TRC's letter cautioned of “enforcement proceedings to impose penalties for violations.” In addition, the letter said the Texas comptroller “may examine the books, records, officers and employees of any company authorized or permitted to do business in Texas that is involved in pari-mutuel wagering.”
