Can I Bet on the Kentucky Derby on the FanDuel Racing App From Texas?

FanDuel Racing is not available in Texas to bet this year's Kentucky Derby, however, there are many great options, including BetUS.  They've been serving the sports and horse racing wagering community since 1994.

Why Can't I Use FanDuel Racing From Texas?

As specific wagering restrictions vary at the discretion of each state, some states have additional and more complex rules and restrictions than others. Each unique state's restrictions are listed below for your convenience.

FanDuel Racing is not available in Texas due to state gambling laws that prohibit advance deposit wagering (ADW) — the method by which people typically bet on horse races online.

The state made its opinion known back in 2011.  Prior to this, Texas would be off and on in regard to allowing betting horses online.

The Texas Racing Commission sent out letters that year to various horse betting sites licensed in the US, TwinSpires included, making it clear that they could lose their licenses.  International sites for the most part remained undaunted, mainly since they do not physically accept bets inside the United States.  They also do not blatantly advertise in the state.  TwinSpires features prominently during the Kentucky Derby broadcasts.

“The TRC's letter cautioned of “enforcement proceedings to impose penalties for violations.” In addition, the letter said the Texas comptroller “may examine the books, records, officers and employees of any company authorized or permitted to do business in Texas that is involved in pari-mutuel wagering.”

Because sites like BetUS operate with an international gaming license, they are not subject to some of the same restrictions encountered by online race books that operate from within the United States.  We should also note that there are plenty of other sites that operate from offshore that take bets in Texas.
