LAS VEGAS, Nev (Gambling911.com) - An individual has filed a lawsuit claiming he was exposed to Legionnaires’ disease during a January stay at the resort and later required hospitalization.

Ruben Feliciano, whose current residency only mentions the state of Florida, filed the negligence lawsuit Aug. 25 in Clark County District Court against Wynn Las Vegas with reports of the incident only remerging this week.
The complaint claims that Feliciano checked into the resort Jan. 12 and stayed through Jan. 15, 2026, and began feeling ill during his visit. After returning home, Feliciano was hospitalized from Jan. 22 through Jan. 25, according to the lawsuit. He later received a letter notifying him that he may have been exposed to Legionnaires’ disease during his stay, the complaint says.
Legionnaires’ disease is a potentially severe form of bacterial pneumonia caused by Legionella bacteria. It is particularly relevant to hotels and resorts because the bacteria can multiply in large, complex building water systems if conditions allow. Hotels are a classic setting for Legionnaires' investigations because they have extensive plumbing, showers, hot-water systems, pools/spas and sometimes cooling towers. Legionnaires’ disease is not generally thought to be spread from person to person.
Infection usually occurs by inhaling tiny droplets or mist containing Legionella.
Symptoms tend to appear 2–14 days after exposure and can include fever, cough, shortness of breath, headache and muscle aches. Some patients develop diarrhea, nausea or confusion.
It can be quite serious though antibiotic treatment early on helps to improve chances of recovery. The CDC estimates that about 1 in 10 people who develop Legionnaires’ disease die from complications, and hospitalization is common. Risk is substantially higher among people 50 and older, current or former smokers, people with chronic lung disease and people with weakened immune systems or certain underlying illnesses.
The lawsuit says the Southern Nevada Health District opened an investigation in April into possible Legionnaires’ disease exposure at the resort tied to stays from September 2025 through February 2026 with multiple samples testing positive for Legionella, the bacteria that can cause Leionnaires' disease.
“Immediate, proactive steps were taken to remediate the system and ensure the highest standards of water quality," Wynn said in a statement following release of the Southern Nevada Health District findings.
Wynn also said that ongoing testing conducted with SNHD showed no ongoing risk to guests and that it had implemented a comprehensive water-management safety plan intended to prevent recurrence.
According to SNHD, Wynn undertook water-system remediation, conducted follow-up testing, cooperated with the investigation and directly notified guests about potential exposure. Subsequent samples showed no detectable Legionella in the affected areas.
Wynn has not admitted liability in the Feliciano matter.
Feliciano alleges Wynn failed to properly maintain the hotel for cleanliness and while also failing to warn guests about a hazardous condition.
He is seeking more than $15,000 in general damages, more than $15,000 in special damages, attorney’s fees, and court costs.
For those who stayed at the Wynn Resort during the period between September 2025 and February of this year, long-term health problems reported in survivors include persistent fatigue, shortness of breath or reduced lung function, muscle weakness, neurological symptoms such as concentration or memory difficulties, and reduced overall quality of life.
Testing for Leionnaires' disease exposure weeks later is difficult to prove.
